Terms of Use

These Terms of Use ("Terms") govern your use of the Mafia mobile application (the "App") developed and published by Hye Labs LLC ("Hye Labs," "we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. License

Subject to your compliance with these Terms, Hye Labs grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on Apple-branded devices that you own or control, solely for your personal, non-commercial use. This license does not allow you to use the App on any device that you do not own or control, and you may not distribute or make the App available over a network where it could be used by multiple devices at the same time.

The App is licensed to you, not sold. Hye Labs retains all right, title, and interest in and to the App, including all intellectual property rights therein.

The App is intended for users aged 13 and older. By using the App, you represent that you are at least 13 years old (or the minimum age required in your jurisdiction). If you are under the age of 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

2. Restrictions

You agree not to:

• Copy, modify, adapt, translate, reverse engineer, decompile, disassemble, or create derivative works based on the App
• Rent, lease, lend, sell, sublicense, assign, distribute, publish, transfer, or otherwise make the App available to any third party
• Remove, alter, or obscure any proprietary notices (including copyright and trademark notices) on the App
• Use the App for any unlawful, harmful, or fraudulent purpose
• Use the App in any manner that could damage, disable, overburden, or impair the App

3. User Content

The App allows you to enter player names during game setup. These names are stored only on your device and are not transmitted to any server or third party, except when you use the optional QR Code role distribution feature (see Section 3D below). You are solely responsible for the content you enter into the App. You agree not to enter names or content that is offensive, defamatory, obscene, or otherwise objectionable.

3A. Diagnostic & Analytics Data

The App collects anonymous crash reports, performance data, and usage analytics to help us identify and fix issues and understand how the App is used. This data does not include any personal information and is not used by us to identify you. By using the App, you consent to the collection of this anonymous data. 3B. In-App Purchases

The App may offer in-app purchases ("Purchases") for additional content or features. All Purchases are processed through Apple's App Store and are subject to Apple's terms and conditions. By making a Purchase, you acknowledge and agree that:

• All payment processing is handled by Apple. Hye Labs does not collect or store any payment information.
• Purchases are final and non-refundable, except as required by applicable law or Apple's refund policies.
• Access to purchased content is tied to your Apple ID and may be restored on devices signed in to the same Apple ID.
• Prices are subject to change. Any price changes will not affect previously completed Purchases.
• All in-app content and features are licensed to you, not sold. You acquire no ownership interest in any purchased content.
• Purchased content has no real-world monetary value and cannot be redeemed, refunded, or exchanged for cash or any other tangible value, except as required by applicable law.
• Purchased content is non-transferable and may not be traded, given away, or assigned to another user.
• In the event your access to the App is terminated for violation of these Terms, any purchased content may be forfeited.
• We reserve the right to modify the availability or features of in-app content at any time. Changes will not affect previously completed Purchases.
• A "Restore Purchases" feature is available within the App to recover previously purchased content on your current device or other devices signed in to the same Apple ID.

For refund requests, please contact Apple Support directly through your purchase history in the App Store.

3C. Advertising

The App displays optional rewarded video advertisements provided by Google AdMob, a third-party advertising service. By using the App, you acknowledge and agree that:

• Rewarded advertisements are entirely voluntary. You may choose to watch an ad in exchange for temporary access to in-game content (valid for one game session).
• Ad rewards are virtual, have no real-world monetary value, and are subject to the same terms as in-app purchased content (non-transferable, non-refundable, forfeited on termination).
• We do not guarantee the availability of advertisements at any given time. Ad availability depends on third-party ad networks and may vary by region.
• Rewards may not be granted if an advertisement fails to load or complete. We are not responsible for technical issues with third-party ad networks that prevent reward delivery.
• Third-party advertising providers (including Google) may collect device identifiers, IP address, and ad interaction data to serve and measure advertisements. For details, see our Privacy Policy.
• You are prohibited from manipulating, automating, or fraudulently interacting with advertisements, including using bots, auto-clickers, emulators, or any means to generate invalid ad impressions or clicks. Violation may result in termination of your access to the App and forfeiture of all content.
• We do not control and are not responsible for the content of third-party advertisements displayed within the App. Any interaction with advertised products or services is solely between you and the advertiser.
• We reserve the right to modify, suspend, or remove rewarded ad content or the rewards associated with it at any time, without prior notice.

3D. QR Code Role Distribution

The App offers an optional QR Code role distribution feature that allows players to receive their roles on their own devices by scanning a QR code displayed by the Game Master. By using this feature, you acknowledge and agree that:

• Player names and game configuration (number of players, role assignments) are temporarily transmitted to a relay server operated on our behalf to facilitate role distribution.
• This data is stored temporarily (maximum 30 minutes) and is automatically deleted after the session expires. No data is retained after the game session ends.
• The QR Code feature requires an active internet connection. We do not guarantee uninterrupted availability of this feature. Network conditions, server maintenance, or other factors may affect availability.
• The web-based role reveal experience accessed via the QR code is provided "as is" without warranties of any kind.
• You are responsible for ensuring that the QR code is shared only with intended participants in your game session.
• The standard phone-passing mode is always available as an alternative and does not require an internet connection or transmit any data.

4. Intellectual Property

The App, including its design, graphics, user interface, artwork, text, and all other content, is the property of Hye Labs LLC and is protected by copyright, trademark, and other intellectual property laws. "Mafia" as used in the App refers to the classic social deduction party game genre and does not imply any endorsement of or association with real-world criminal activity.

The Hye Labs name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Hye Labs LLC. You may not use such marks without our prior written permission.

5. Third-Party Terms

Your use of the App is also subject to the terms and policies of Apple Inc., including the Apple Media Services Terms and Conditions and the App Store Terms of Service. In the event of a conflict between these Terms and Apple's terms, Apple's terms shall govern with respect to your use of Apple services.

You acknowledge and agree that:

• These Terms are between you and Hye Labs only, and not with Apple. Hye Labs, not Apple, is solely responsible for the App and its content.
• Apple has no obligation to furnish any maintenance and support services with respect to the App.
• In the event of any failure of the App to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price for the App (if any). To the maximum extent permitted by applicable law, Apple has no other warranty obligation with respect to the App.
• Hye Labs, not Apple, is responsible for addressing any claims relating to the App, including product liability claims, claims that the App fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection or similar legislation.
• In the event of any third-party claim that the App infringes that third party's intellectual property rights, Hye Labs, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.
• Apple and its subsidiaries are third-party beneficiaries of these Terms, and Apple will have the right to enforce these Terms against you as a third-party beneficiary.

6. Disclaimer of Warranties

Hye Labs does not warrant that the App will be uninterrupted, error-free, or free of harmful components. We do not guarantee that the App will be available at all times. You use the App at your own risk. No advice or information, whether oral or written, obtained from Hye Labs or through the App shall create any warranty not expressly stated herein.

7. Limitation of Liability

To the fullest extent permitted by applicable law, in no event shall Hye Labs, its affiliates, officers, directors, employees, agents, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, use, goodwill, or other intangible losses, arising out of or in connection with your use or inability to use the App, regardless of the theory of liability (contract, tort, or otherwise) and even if Hye Labs has been advised of the possibility of such damages.

In no event shall Hye Labs' total liability to you for all claims arising out of or in connection with the App exceed the greater of: (a) the amounts you have paid to Hye Labs for the App or in-app purchases in the twelve (12) months preceding the claim, or (b) ten U.S. dollars ($10.00).

8. Indemnification

You agree to defend, indemnify, and hold harmless Hye Labs, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or relating to your use of the App or your violation of these Terms.

9. Termination

These Terms are effective until terminated. Your rights under these Terms will terminate automatically if you fail to comply with any of their provisions. Upon termination, you shall cease all use of the App and destroy all copies of the App in your possession. Sections 3B, 3C, 3D, 4, 6, 7, 8, 11, and 12 shall survive any termination of these Terms.

10. Changes to These Terms

We reserve the right to modify these Terms at any time. When we do, we will revise the "Last Updated" date at the top of this page. Material changes will be communicated through the App or the App Store update description. Your continued use of the App after any changes constitutes your acceptance of the updated Terms.

11. Export Compliance

You may not use or otherwise export or re-export the App except as authorized by United States law and the laws of the jurisdiction in which the App was obtained. You represent and warrant that you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.

12. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law provisions. Any dispute arising out of or in connection with these Terms or the App shall be resolved exclusively in the state or federal courts located in Collin County, Texas, and you consent to the personal jurisdiction of such courts.

13. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Hye Labs regarding the App and supersede all prior agreements, understandings, and communications, whether written or oral.
